UNGA’s New Initiatives on AI Governance

Context

A resolution by the UN General Assembly to establish two new institutional mechanisms to promote international collaboration on AI governance was launched by the UN Secretary-General.

• United Nations Independent International Scientific Panel on AI:

• • Goal: Intended to serve as an inclusive, multi-stakeholder forum within the United Nations where member states, academia, civil society, and the commercial sector may interact. 

Importance

• The United Nations Secretary-General referred to it as a “pathbreaking milestone.”
• Seeks to promote international cooperation while balancing the benefits and hazards of artificial intelligence.

Need for regulations for AI

• Ethical Issues: AI systems possess the capacity to make decisions and take actions that affect individuals and society.
• Privacy: AI frequently involves the processing of vast quantities of data. Regulations may help safeguard individual privacy by outlining the manner in which data should be gathered, maintained, and utilized.
• Security: This encompasses both defense against potential vulnerabilities and protection against the improper use of AI technology.
• Transparency: AI systems may be subject to rules that mandate transparency, requiring developers to explain the functioning of their algorithms.
• Competition and Innovation: By creating a regulatory framework that promotes fair competition and prevents the misuse of market power, we can foster responsible innovation.
• Public safety: It is crucial to establish regulations to guarantee safety in cases where AI is used in vital sectors such as healthcare, transportation, or public infrastructure. 

India’s AI Laws

• Currently, there is no specific AI legislation in India. Existing legislative frameworks indirectly regulate AI.
• The IT Act of 2000 addresses cybercrimes as well as intermediary liability.
• The Digital Personal Data Protection Act of 2023 guarantees data protection and agreement.
• IPR legislation (Copyright & Patents Acts): important for inventions and works created by AI.
• India is a member of the GPAI, which is a global partnership on artificial intelligence. New Delhi hosted the 2023 GPAI Summit, where GPAI specialists discussed their research on the future of work, innovation, commercialization, data governance, and responsible AI.
• The NITI Aayog’s National Strategy for Artificial Intelligence, dubbed the #AIForAll strategy, included AI research and development principles centered on healthcare, agriculture, education, and “smart” cities as well as infrastructure, intelligent mobility, and transformation.
• Guidelines for Ethical AI Principles for Responsible AI, a discussion paper that addresses the many ethical issues related to implementing AI solutions in India, was published by the NITI Aayog in February 2021.

Regulatory Issues

• The rapid development of AI makes it hard to create laws that will stand the test of time.
• Striking a balance between promoting innovation and maintaining safety is a difficult task.
• International Collaboration: To prevent a fragmented environment, international cooperation is essential for effective AI legislation.
• Defining AI: It’s challenging to regulate AI successfully because there is no common understanding of what it is.
