U.S. Russia Sanctions Act: Implications for India

Syllabus: IR [GS 2]

Context

The U.S. Russia Sanctions Act marks a significant shift in U.S.-India trade relations. It allows the U.S. executive to impose tariffs of up to 100% on countries such as India that maintain significant energy trade with Russia, particularly Russian oil and gas.

Key Provisions of the Act

  • Steep Tariff Authority: The Act authorizes the U.S. President to impose punitive trade tariffs of up to 100% on goods imported from major buyers of Russian energy.
  • Target Criteria: It targets countries in the top five list of crude oil imports and/or top five list of natural gas imports over the past 12 months and those who it deems to be “significant facilitators” of sanctions evasion.
  • The 30-Day Window: Tariffs can be triggered if a target country knowingly executes new purchases of Russian crude after a specified 30-day grace period following the law’s enactment.
  • Presidential Waiver Clause: The law is not automatically self-executing. It provides the U.S. President with discretionary authority to waive or delay implementation of the tariffs if they are “necessary to the national defense or national security of the United States.

Why it Critically Disrupts India

India finds itself directly in the crosshairs of this legislation due to its deep energy dependencies:

  • Unprecedented Import Volume: Following the 2022 Ukraine crisis and subsequent Western pullbacks, India aggressively escalated its purchases of discounted Russian crude. As of July 2026, the share of Russian crude oil in India’s total crude oil imports was over 51%, higher than all the top six suppliers combined.
  • Choked Alternative Routes: Geopolitical uncertainty and disruption in the Strait of Hormuz prevent the sourcing of oil from traditional West Asian suppliers from becoming more viable.
  • Macroeconomic Vulnerability: With global Brent crude prices hovering above $100 a barrel, India’s crude import bill already forms a massive chunk of its overall trade deficit. If India chokes on the Russian oil at the lower rate, it will face serious inflationary pressures in the country.

Multi-Dimensional Implications for India.

A. Geopolitical & Strategic Autonomy

  • Pushing the boundaries of Indian strategic independence. Washington uses extraterritorial domestic law to dictate New Delhi’s sovereign choices of energy.
  • It throws a spanner in the works of India’s strategic partnership with the U.S. (such as in Quad, iCET), thus adding friction to an alliance which is largely united in their opposition to China.

B. Social & Environmental Risk Management

  • The U.S. is the largest export market for India with about 20% of the country’s total merchandise exports.
  • A 100% tariff wall would put a stumbling block in the way of India’s export goals, thereby not only causing the loss of low-margin MSMEs but also marring the competitiveness of products like textiles, pharmaceuticals and engineering goods.

C. Energy Security

  • Replacing nearly half of the country’s crude intake overnight is logistically impossible. It compels Indian state-run oil refiners to make a difficult political decision between economic losses and U.S. sanctions.

Way Forward for India

  • Diplomatic Leverage & Trade Negotiations: India needs to use the next high-level platforms like the G-20 Trade Ministerial to negotiate a Presidential Waiver. New Delhi has to convey this message – otherwise, the international energy market will get unstable if Indian demand is suddenly diverted.
  • Quick infrastructure diversification: India has to move more quickly to diversify its port capacity away from the choke points to other channels and to push its stable partners such as Oman to do the same.
  • Strategic Hedging: Shift towards other non-Gulf sources, such as barrels from Africa and South America (e.g. Venezuela) gradually to diversify import basket without giving up the use of Russian supplies.
