Context
Crèches in India are legally mandated child-care facilities governed by the Maternity Benefit (Amendment) Act, the Code on Social Security, and the National Minimum Standards and Protocol for Crèches. The regulations cover all workplaces with 50 or more staff, to help working parents find safe, hygienic and reliable childcare for their child aged between 6 months and 6 years.
Legality and applicability of the law
- Statutory Threshold: Establish a crèche facility at any place of work (private companies, factories, mines, plantations and the like) where 50 or more employees work. This policy is applicable to all employees, including permanent staff, contractual staff, temporary staff and third party staff.
- Proximity and Access: The crèche should be within the office premises or within 500m from the main entrance to the workplace. Employers can also use an external specialist crèche service provider within this geographical area to meets the compliance requirement.
- Employee Entitlements: Working mothers have a right to make four visits a day to the crèche facility. These visits are conducted with their regular rest periods. Time spent travelling to and from crèche is included in their normal working time.
Infrastructure and Spatial Standards
- Location and Safety: Crèches should be on the ground floor of a building, if possible, for smooth emergency evacuation. It has to be constructed with fire-proof materials, and must be kept dry, and must be placed away from areas where heavy foot traffic, high voltage transformers or industrial hazards such as fumes and excessive noise may exist.
- Space Allocation: The facility should have at least 10 to 12 square feet of space per child. This area should be clearly separated into separate functional areas, such as:
- Special sleeping and resting space for babies.
- Toddler Active Play and Early Learning area.
- Private cubicle for nursing mothers with good ventilation and hygiene.
- Sanitation and Ventilation: The crèche must maintain cross-ventilation, adequate natural light, and a comfortable temperature. It should include child-friendly, low height toilets with a constant running water supply, clean liquid hand wash and safe, filtered drinking water which is available at all times.
Staffing and Caregiver Ratios
- The Ministry of Women and Child Development prescribes adult-to-child ratios that are mandatory, depending on the child’s age to ensure focused care is delivered:
- Children under 3 years: One trained caregiver and one helper for every 10 children.
- Children from ages 3 to 6: One trained caregiver and one helper per 20 children.
- Qualifications and Background Checks: All crèche staff must undergo thorough police verification and background checks before hiring. Caregivers should have a certificate in early childhood care, have regular medical fitness certificates as proof that they are free of communicable diseases and should have an empathetic temperament, which is necessary for the management of young children.
Safety, Monitoring, and Governance
- Digital Surveillance: Employers will be required to fit CCTV cameras in the common areas within the crèche. Secure live feed should be available for parents to view so that they can see what is going on and ensure that the child is safe.
- Administrative Oversight: Each facility needs to establish a Crèche Administrative Committee (CAC). Employer representatives, crèche supervisors and two parent representatives should serve on this committee. The CAC monitors hygiene issues once a month, reviews safety issues and hears parent concerns.
