Laws on mercenaries in war zones
Syllabus: International Relations [GS Paper-2]

Context
The ongoing conflict between Russia and Ukraine has seen the involvement of mercenaries from various countries, including India. The recent deaths of two Indian nationals in the conflict have raised concerns about the status and accountability of mercenaries in international law.
Background
India has strained relations with Russia due to attempts to recruit Indian citizens in the Russian Army for the war against Ukraine. It has been reported by the Indian government that more than 10,000 of its citizens are trapped in the Russian army and the government is actively lobbying to help them return home as soon as possible.
Who are Mercenaries?
The mercenaries are those who fight in wars with no personal ideologies, agendas or reasons other than for the sake of monetary gains. These two do not fall under normal armies and their service is for hire for a certain party, it could be a government, company or an individual. Military professionals sometimes work as mercenaries and may act in places that are prohibited under international law. The term ‘mercenary’, one can say is ‘loaded’ with pejorative connotations, at the same time it is also used to refer to people who participate in armed conflicts for monetary rewards. Ever since mercenaries are interested in money and other promissory incentives they do not have specific policing and discipline restraints similar to most military forces.
Legal Framework
- It is under the laws of International Law that there are guidelines on mercenaries outlined in the Convention on the Rights and Duties of States-Montevideo 1989 and the Additional Protocol 1 to the Geneva Conventions August 1977.
- According to the Montevideo Convention mercenaries are persons who are hired for the purpose of fighting with weapons, and the Additional Protocol I does not allow the use of mercenaries in international and internal armed conflict.
Status of Mercenaries
- Mercenaries are legalized under the laws and customs of animal combat and are thus referred to as combatants.
- The other is that they should be accorded the same status of combatants and must be protected under humanitarian consideration as well as under the laws of war as far as universal jurisdiction is concerned, they can be tried for any misconduct they may have displayed.
Accountability of Mercenaries
- Mercenaries in the international law area also attributed individual criminal responsibility in the conduct of their operations.
- This means that anyone who commits a crime during armed conflict and acts for financial benefit, cannot escape the law and can be prosecuted for his or her criminal activities.
Indian Government’s Response
The Indian government has taken a stern view of the Russian Army’s continued recruitment of Indian nationals for the conflict in Ukraine. The Ministry of External Affairs (MEA) has demanded that the Russian authorities stop all illegal recruitment of Indian nationals and have also urged the Russian government to facilitate the early release and return of all Indian nationals currently serving with the Russian Army.
Conclusion
The deaths of two Indian nationals in the Russia-Ukraine conflict highlight the need for greater awareness and understanding of the legal framework governing mercenaries in international law. The Indian government’s response to the situation underscores the importance of protecting the rights and interests of its nationals who are involved in armed conflicts abroad.
